By auditioning and/or enrolling your child as a Student at National Performing Academy Ltd (trading as “National Performing Academy” and “Young Drama”, hereafter referred to as “NPA”), you acknowledge and agree to these Terms and Conditions as an ongoing agreement between you and National Performing Academy Ltd (“Agreement”).
The Agreement is made by and between the legal parent(s)/guardian(s) (“Parent”, “you” or “your”) on behalf of each prospective or enrolled student (“Student”) and National Performing Academy (“National Performing Academy”, “NPA”, “we”, “our”, “us”), forming a binding and ongoing agreement valid at all times whilst the Student is takes part in any National Performing Academy Activities.

1. DEFINITIONS
1.1. “NPA Activities” refer to all our sessions, classes, auditions, and performances, workshops, as well as any additional products and/or services.
1.2. A “Session” refers to a course (“Course”) of lessons and/or individual lessons delivered during then Term offering drama tuition. Sessions will take place as detailed at the time of booking.
1.3. An “Audition” refers to a performance-based workshop that displays the Student’s talents completed by the Student alongside other students that wish to gain a place and therefore enrol to an NPA Activity. A successful Audition is required for enrolment.
1.4. “Workshop” refers to a one-off Course offering tuition of one or multiple Performing Arts disciplines (acting, dancing, singing) or related activities which will be delivered for a defined number of hours per day, for a period of between one (1) and six (6) consecutive days. These can run anytime throughout the year.
1.5. “Extra-Term Workshops” refers to Workshops that run outside of term time.
1.6. “Academy Director” refers to the Manager of a particular NPA location.
1.7. “Term” refers to one normal NPA academic term during which Sessions are run.
1.8. “Term Dates” refers to the dates for the relevant Term.
2. GENERAL
2.1 When registering a new Student, either online or by signature, Parents are required to complete a Registration Form to be submitted to us in person or online.
2.2 By signing the Registration Form, Parents consent to these Terms & Conditions for each Student participating in an NPA Activity. These Terms & Conditions may be updated from time to time.
2.3 These Terms & Conditions are provided as is, and any modifications shall not be accepted by NPA unless they are confirmed in writing.
2.4 Students are enrolled for one Term at a time, and a full Term schedule will be made available during enrolment.
3. ENROLMENT
3.1 For prospective students, the Parent is required to agree to these Terms & Conditions while submitting an application form, prior to having an audition.
3.2 Each prospective Student has to audition to take part in an NPA Course. Places are allocated to those have successfully auditioned. Following a successful audition, Parents will be sent details on how to enrol and pay any term fees on our online portal.
3.3 Extra-Term Workshops may be, if advertised, exempt from the Auditions requirement.
3.4 Student spaces for any NPA Activity are allocated on a “first come, first served” basis.
3.5 If the case NPA is unable to enrol the Student on capacity grounds, the Parent can choose to place the Student on a reserve list.
4. CANCELLATION
4.1 If you wish to cancel a Student enrolment in an NPA Activity, you may do so at any time within 14 days from the confirmed enrolment, whether payment has been made yet or not, (called the “Cancellation Period”). You must inform us in writing of your decision to cancel within the cancellation period to exercise this right.
4.2 If an NPA Activity begins before the end of the Cancellation Period, and you subsequently exercise your cancellation rights, you may be liable to pay part the cost of the NPA Sessions that have been provided during the Cancellation Period. If we issue a refund, this may be deducted from the total amount refunded.
4.3 Once an NPA Activity has been completed, you will not be able to cancel, even if the cancellation period is still running
5. PAYMENT
5.1 Sessions must be paid for in advance. Students may be refused entry to a Session if payments are in arrears.
5.2 We use a software system for the administration and the collection of any Fees.
5.3 Workshop or Extra-Term Workshop enrolment requires full payment in advance. At the discretion of NPA, a place may be confirmed with a partial payment or deposit, with the outstanding balance due to NPA by the first day of the Workshop.
5.4 Following a successful audition, and on confirmation of a Student’s enrolment on a NPA Activity, you will be issued with an Invoice for the fee(s) applicable, which will contain payment deadlines and details of accepted payment methods.
5.5 If payment cannot be collected from you, and after any reasonable efforts we do not receive any payment from you when due, then we reserve the right to terminate this Agreement and offer the space to a prospective student on the reserve list.
5.6 Payment invoices are issued to Students for the next term automatically four weeks before the start of the new term, unless they give four week’s notice under these Terms and Conditions.
6. RE-ENROLMENT
6.1 Once enrolled, Students and Parents will be told Term Dates for the next Term in writing at the end of the current Term. Term dates will also be published on the relevant websites.
6.2 Those enrolled in one of our Courses will be assumed to be attending the next Term of classes unless four weeks’ notice is provided before the commencement of the Term. Without such notice, a place will be held on behalf of the Student and you may liable to pay us the fees due for that Term.
6.3 If you don’t wish for a Student to automatically be re-enrolled for the next Term, please inform us when registering your child.
7. MARKETING AND PUBLICITY
7.1 NPA own websites and a public social media accounts. News and events are shared on these websites and social media accounts from time to time.
7.2 NPA may take photographs and videos during and from any NPA Activities, including but not limited to: auditions, lessons, rehearsals, workshops or productions, which will be used for any advertising and publicity purposes, as well as National Performing Academy’s archive indefinitely.
7.3 NPA may post such images of Students on NPA websites, social media accounts, and any publicity (whether in print or online). If a Student is featured within an image or video and identified with their name, only their first name will be used and never a full name.
7.4 Photographs and video may, although discouraged, be taken by audience members during performances and posted on social media and you agree you are aware and give permission for this.
7.5 You understand Student photographs may appear in performance programmes.
7.6 You also understand that videos of NPA Activities and performances may be taken for advertising and archive purposes.
7.7 Any content created by NPA may be used even if the student is no longer enrolled with NPA.
8. HEALTH AND SAFETY
8.1 Students attend and take part in NPA Activities at their own risk.
8.2 Suitable footwear and clothing must be worn my Students at all times.
8.3 You are required to inform NPA of any injuries and medical conditions present during enrolment, and those suffered or diagnosed during Term time.
8.4 If in doubt whether a Student can take part, consult your child’s GP prior to enrolment.
8.5 Any medication taken to or left on NPA premises must be clearly labelled and, if needed, the Student should be able to self-administer this medication, unless we agree in writing otherwise.
8.6 In the event a Student falls ill or has an accident during an NPA Activity requiring emergency treatment, you will be contacted via the provided emergency contact details. This number must always be contactable while the Student is at NPA Activities. You are responsible for ensuring that the emergency contact details are up to date.
9. SAFEGUARDING POLICY
9.1 The safety of of our Students and Staff are of the upmost importance to us here at NPA.
9.2 All of NPA’s staff and volunteers are DBS checked, and at least one member of staff will be first aid trained. A

10. PERSONAL PROPERTY
10.1 NPA accepts no responsibility for any loss or damage to personal belongings, and Students are responsible for taking care of any of their personal belongings.
10.2 The maximum liability of NPA to a Student or Parent under these T&Cs shall not exceed the class fee to which the claim relates.
10. 3 The liability of NPA and that of any member of its staff is only in respect of class time and further restricted to gross negligence only.
10.1 NPA may at its own discretion, refuse a Student entry to an NPA Activity or session of an NPA Activity if if it is felt that the Student’s behaviour is unacceptable
11. FURTHER CONSIDERATIONS
11.1Students are expected to attend sessions regularly.
11.2 We have a zero tolerance policy for rudeness, bullying, and/or unnacceptable behaviour from both Students and/or Parents. This means that we may refuse Students entry, ask them to leave, or cancel their enrolment.
11.3 We reserve the right to make any changes to the Term or Workshop schedules, staff, programmes, delivery mechanism for the NPA Activities, in the event of illness or circumstances beyond our control.
11.4 In the event an NPA Activity or Session is cancelled, we will give you as much notice as possible. If the cancellation is last-minute, we may notify you by email, NPA social media accounts, text, or call. Please provide us with up-to-date contact details.
11.5 In the event an NPA Activity or Session is cancelled, we will provide replacement NPA Activities or Sessions, which may include a change of date, time or venue. If an alternative cannot be offered, we will refund the cost of the NPA Activity or Session that was not fulfilled.
11.6 It may be the case that sometimes we have to change the time or venue of an NPA Activity, but this is only done if it’s absolutely necessary. We endeavour to keep our sessions and locations as similar as possible.
11.7 If a Student is unable to attend an NPA Activity or Session due to illness, holiday or a decision not to attend by either the Parent or Student, we are unable to provide a refund.
11.8 Students must be collected after an NPA Activity or Session on time. We are unable to supervise Students after an an NPA Activity or Session, and late collection penalties may be made payable if there is consistent late collection.
11.9 Our fees are reviewed termly and may be increased each term.
11.11 These Terms & Conditions, together with any invoice and enrolment letter constitute the entire agreement between the parties which supersedes and extinguishes all previous agreements, promises, assurances, warranties, representations and understandings between them, whether written or oral, relating to its subject matter.
11.12 In the event that one or more of the provisions of the Agreement are found to be unlawful or otherwise unenforceable, those provisions shall be deemed severed from the remainder of the Agreement.
11.13 The Agreement shall be governed by, and construed in accordance with, the laws of England and Wales and any dispute, proceedings or claim shall fall within the jurisdiction of the English courts.
